1. Acceptance of Terms

Welcome to Yuh Bright? ("we," "us," "our," or the "App"). By creating an account, accessing, or using our educational gaming platform and any related services (collectively, the "Service"), you agree to be bound by these Terms & Conditions ("Terms"). If you do not agree to these Terms, you must not access or use the Service. If you are a parent or legal guardian registering on behalf of a minor, you accept these Terms on behalf of the minor and are responsible for their use of the Service.

2. Age Requirements & Parental Consent

• The Service is designed for students in Grades 1 through 13 (approximately ages 6-18) in the Caribbean education system.
• Users under the age of 18 must have the consent of a parent or legal guardian to use the Service.
• Users under the age of 13 must have a parent or legal guardian register and manage their account. We do not knowingly collect personal information from children under 13 without verifiable parental consent.
• By allowing a minor to use the Service, parents and guardians accept full responsibility for the minor's activities and any content submitted through the account.
• Parents may review, update, or request deletion of their child's account and associated data at any time by contacting us through the Parents' Dashboard or by requesting deletion.

3. Description of Service

Yuh Bright? is an educational gaming platform that provides curriculum-aligned study quizzes, interactive learning games, an AI-powered tutor ("Ask Bright"), gamified rewards, leaderboards, and progress tracking for parents. The Service covers Caribbean curricula including PEP, CSEC, and CAPE preparation across multiple subjects.

4. User Accounts & Responsibilities

• You must provide accurate and complete information when creating your account, including your name and school.
• You are responsible for maintaining the confidentiality of your login credentials and for all activities under your account.
• You agree to notify us immediately of any unauthorized use of your account.
• One person may not maintain multiple accounts to manipulate leaderboards, coin balances, or rewards.
• We reserve the right to suspend or terminate accounts that violate these Terms.

5. Virtual Currency & Bright Coins

• "Bright Coins" are a virtual in-app currency earned by completing quizzes, playing games, maintaining streaks, and achieving milestones.
• Bright Coins have no real-world monetary value, cannot be purchased with real money, and cannot be exchanged for cash or any currency.
• Bright Coins can be redeemed for digital items and rewards within the App, subject to availability.
• We reserve the right to adjust the earning rates, redemption costs, and availability of items at any time without prior notice.
• Bright Coins are non-transferable between accounts and expire if an account is terminated or inactive for more than 12 months.

6. Gaming Prizes & Reward Redemption

• The Service offers digital gaming prizes including but not limited to Robux, V-Bucks, Minecraft Minecoins, and gift cards for Google Play, Apple, Amazon, PlayStation, Xbox, and Netflix (collectively, "Gaming Prizes").
• Gaming Prizes are subject to availability and may be substituted or discontinued at any time without notice.
• Redemption of Gaming Prizes requires verification. Codes or vouchers will be sent to the email associated with the account or the parent's email for minors.
• We are not responsible for lost, stolen, or expired codes once they have been delivered to the user.
• Gaming Prizes are provided by third-party platforms (e.g., Roblox, Epic Games, Google, Apple). We are not affiliated with or endorsed by these companies. Their respective terms and conditions apply to the use of redeemed prizes.
• Fraudulent redemption attempts, including but not limited to creating multiple accounts or exploiting system vulnerabilities, will result in immediate account termination and forfeiture of all coins and rewards.
• For users under 18, Gaming Prizes will be delivered to the parent or guardian's email address on file.

7. Yuh Bright Plus (Premium Subscription)

• "Yuh Bright Plus" is an optional premium subscription that provides unlimited quizzes, unlimited AI tutor access, and other enhanced features.
• Subscription fees, billing cycles, and features are displayed within the App and may change at any time.
• Subscriptions auto-renew unless cancelled before the renewal date.
• All subscription payments are non-refundable except where required by applicable law.
• We reserve the right to modify or discontinue Yuh Bright Plus features at any time.

8. Acceptable Use Policy

You agree NOT to:

• Use cheats, exploits, automation software, or any unauthorized tools to gain an unfair advantage.
• Attempt to hack, disrupt, or reverse-engineer the Service or its underlying systems.
• Submit false, misleading, or inappropriate content, including offensive names or messages.
• Harass, bully, or discriminate against other users through leaderboards, names, or any other feature.
• Use the Service for any illegal or unauthorized purpose.
• Share your account credentials with others or allow others to use your account.

9. Privacy & Data Protection

• We collect and store the following data: your name, school, grade level, game scores, XP, coins, badges, and usage patterns.
• This data is used to provide the Service, generate leaderboards, track progress, personalize content, and provide parents with insights.
• We do not sell personal data to third parties.
• For users under 18, parents and guardians have the right to access, review, correct, or delete their child's personal data at any time.
• Game sessions (scores, subjects, accuracy) may be displayed publicly on leaderboards using the player's chosen name.
• AI-generated content (quizzes, tutor responses) is processed by third-party AI providers. Do not share sensitive personal information through these features.

10. Intellectual Property

All content on the Service, including the Yuh Bright? name, logo, mascot (Brightie), game designs, quiz content, graphics, and software, is owned by us and protected by intellectual property laws. You may not copy, reproduce, distribute, or create derivative works from any part of the Service without our prior written consent. Third-party gaming prize brands (Roblox, Fortnite, Minecraft, etc.) and their logos are trademarks of their respective owners and are used for identification purposes only.

11. AI-Generated Content Disclaimer

Quiz questions, game content, and tutor responses are generated by artificial intelligence. While we strive for accuracy and curriculum alignment, AI-generated content may contain errors or inaccuracies. The Service is an educational supplement and should not replace formal instruction, professional tutoring, or exam preparation guidance from qualified educators. Always verify important information through official curriculum resources.

12. Disclaimer of Warranties

The Service is provided on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, non-infringement, or accuracy. We do not guarantee that the Service will be uninterrupted, error-free, secure, or that quiz content will always be accurate or curriculum-compliant.

13. Limitation of Liability

• To the maximum extent permitted by law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service.
• We are not liable for any loss of virtual currency, rewards, or Gaming Prizes due to technical issues, account termination, or changes to the Service.
• We are not responsible for the actions of third-party platforms associated with Gaming Prizes (e.g., Roblox, Google Play) once prizes have been redeemed and delivered.
• Our total liability for any claim arising from the Service shall not exceed the amount you have paid to us in the preceding 12 months, or $50 USD, whichever is greater.

14. Indemnification

You agree to indemnify and hold harmless Yuh Bright?, its officers, directors, employees, and partners from any claims, damages, losses, or expenses (including legal fees) arising from your use of the Service, your violation of these Terms, or your infringement of any third-party rights.

15. Leaderboards & Fair Play

Leaderboards display player rankings based on game scores and other metrics. We reserve the right to remove or adjust entries that we believe result from cheating, exploitation, or violation of these Terms. Leaderboard rankings are for entertainment purposes and carry no legal or contractual significance.

16. Account Termination

You may delete your account at any time. We reserve the right to suspend or terminate your account and access to the Service at our sole discretion, without notice, if we believe you have violated these Terms or for any other reason including inactivity, legal requirements, or discontinuation of services. Upon termination, all Bright Coins, rewards, and progress associated with your account will be forfeited.

17. Govering Law & Dispute Resolution

These Terms are governed by the laws of Jamaica and applicable Caribbean laws. Any disputes arising from these Terms or the Service shall first be attempted to be resolved through good-faith negotiation. If unresolved, disputes shall be submitted to the exclusive jurisdiction of the courts of Jamaica. Nothing in this section limits any statutory consumer rights you may have under applicable local laws.

18. Changes to Terms

We reserve the right to modify these Terms at any time. Changes will be effective when posted within the App or on our website. Continued use of the Service after changes constitutes acceptance of the updated Terms. For material changes, we will attempt to notify users through the App. It is your responsibility to review these Terms periodically.

19. Third-Party Links & Services

The Service may contain links to third-party websites or integrate with third-party services (including AI providers, gaming platforms, and payment processors). We are not responsible for the content, privacy practices, or terms of these third parties. Your interactions with third-party services are solely between you and the third party.
